1. Agreement to Terms

By accessing or using Shipnative ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Shipnative is a React Native boilerplate and starter kit that provides pre-configured code, templates, and documentation to help developers build mobile applications. The Service includes source code, documentation, and related materials.

3. License and Use

3.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or commercial projects.

3.2 Restrictions

You agree not to:

  • Copy, modify, or create derivative works of the Service for resale or redistribution
  • Use the Service to create a competing product or service
  • Remove any copyright or proprietary notices from the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service in any way that violates applicable laws or regulations

4. Payment Terms

If you purchase a paid version of Shipnative:

  • Payment is required in advance
  • All fees are non-refundable unless otherwise stated
  • Prices are subject to change with notice
  • You are responsible for any applicable taxes

4.1 Consent to Immediate Delivery

By completing your purchase, you expressly consent to the immediate delivery of the digital content (access to Shipnative source code, documentation, and related materials) and acknowledge that you lose your right of withdrawal once access to the digital content has been granted. This is in accordance with Article 16(m) of the EU Consumer Rights Directive (2011/83/EU) and equivalent consumer protection laws.

5. Refund Policy

All purchases of Shipnative are final and non-refundable, unless otherwise required by applicable law.

Because Shipnative is a digital product delivered immediately upon purchase, refunds are generally not provided once access has been granted.

If you experience technical issues that materially prevent you from accessing or using the product, you may contact support within a reasonable time after purchase. Any refunds issued in such cases are at our sole discretion.

6. No Warranty

Shipnative is provided on an "as-is" and "as-available" basis, without warranties of any kind.

We do not warrant that:

  • the product will be error-free or free of bugs
  • the product will meet your specific requirements
  • integrations with third-party services will remain available or unchanged
  • the product will function uninterrupted or without configuration changes

You acknowledge that software development involves inherent complexity and that updates or modifications may introduce breaking changes.

7. Dispute Resolution

To the fullest extent permitted by law, any disputes arising out of or relating to these Terms or the use of Shipnative shall be resolved through individual proceedings and not as part of a class, collective, or representative action.

Nothing in this section prevents either party from seeking injunctive or equitable relief where appropriate.

8. Lifetime Updates

Where "lifetime updates" are mentioned, this refers to updates made available for the lifetime of the Shipnative product, not the lifetime of the purchaser.

Lifetime updates include improvements, fixes, and changes released at our discretion. We do not guarantee backward compatibility, uninterrupted updates, or continued support for deprecated features.

Users may be required to update or restart projects to benefit from newer versions.

9. Legal Review

These Terms are intended to reflect our current business practices. As our product evolves, we may update these Terms accordingly.

We recommend reviewing these Terms with a qualified legal professional to ensure compliance with applicable laws in your jurisdiction.

10. Intellectual Property

The Service and its original content, features, and functionality are owned by Shipnative and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of any applications you build using the Service, but the Service itself remains our property.

11. User Content

You are solely responsible for any content, code, or materials you create using the Service. You represent and warrant that you have all necessary rights to use such content and that it does not infringe on any third-party rights.

12. Third-Party Services

The Service may integrate with third-party services (e.g., Supabase, RevenueCat, PostHog). Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of information

We do not warrant that the Service will be uninterrupted, secure, or error-free.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIPNATIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

15. Indemnification

You agree to indemnify, defend, and hold harmless Shipnative and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service or violation of these Terms.

16. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Estonia.

18. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
